Terms of Sale

1Purpose

These Terms of Sale (hereafter "TOS") govern the sale of credit packs by Benoit Guionie (ECAB13) to users of the AperoRoom service (aperoroom.com), hereafter referred to as "the Customer".

Credits are a virtual currency used within the service to create live YouTube co-watching Rooms with friends or other users.

3Products and prices

The Seller offers 4 credit packs ("ice cubes"), with bonus credits on the larger packs:

• Party — 50 ice cubes — €4.99
• Open Bar — 200 ice cubes + 20 bonus — €9.99
• Boss — 500 ice cubes + 75 bonus — €19.99
• Tour — 1,000 ice cubes + 200 bonus — €34.99

Each pack purchase also unlocks lifetime tier capabilities (max Room duration, max viewers, concurrent Rooms, max video length). The tier earned is permanent and never downgrades.

Prices are stated in euros (€) and are final (no VAT applicable). Prices and pack composition may change at any time but any change does not affect orders placed before the change. The current catalog is always available at /credits.

4Use of credits

Credits are used to create Rooms within the service. Pricing varies by:

• Room mode (single-screen vs multi-screen)
• Duration of the Room
• Maximum number of participants allowed

The exact cost is shown to the Customer before validation when creating a Room. Credits are debited only after confirmation.

Credits have no expiration date but are linked to the Customer's account and cannot be transferred to another account or converted into cash.

5Order and payment

The order is placed on the page /credits. After clicking "Buy", the Customer is redirected to Stripe, our secure payment partner (PCI-DSS Level 1 certified). The Customer enters his card details directly on the Stripe interface. AperoRoom never collects nor stores bank details.

Accepted means of payment: Visa, Mastercard, American Express, and other methods supported by Stripe.

Once the payment is validated by Stripe, credits are added to the Customer's account within a few seconds via a secure webhook. A confirmation email is sent by Stripe.

6Right of withdrawal

In accordance with Article L221-28, 13° of the French Consumer Code, the right of withdrawal cannot be exercised for the supply of digital content not provided on a tangible medium whose execution has begun after the consumer's express prior consent and waiver of his right of withdrawal.

By validating the purchase of a credit pack, the Customer expressly waives his right of withdrawal, the digital content (credits) being immediately made available on his account.

7Refund

Although there is no right of withdrawal (cf. article 6), the Seller may issue a refund in case of:

• Technical bug attributable to the service that prevents the use of credits
• Double debit on the same purchase
• Charges not authorized by the Customer (fraud)

Refund requests must be sent to info@aperoroom.com with proof of purchase (Stripe receipt). Each request is processed within 14 days maximum.

8Service availability

The Seller endeavors to maintain the service accessible 24/7 but cannot guarantee uninterrupted availability. Maintenance, updates, technical incidents, or external dependencies (YouTube API, Stripe) may temporarily disrupt the service.

The Seller cannot be held responsible for these temporary interruptions. However, a refund may be considered if the unavailability prevents the use of credits purchased recently (cf. article 7).

9Liability

The Customer is solely responsible for the content of the Rooms he creates and the videos he proposes. He undertakes to respect YouTube's Terms of Service and applicable laws (no incitement to hatred, no illegal content, no copyright infringement).

The Seller reserves the right to delete, without notice, any Room or account violating these rules, without right to refund.

10Applicable law and disputes

These TOS are governed by French law. Any dispute relating to their interpretation or execution falls under the jurisdiction of the competent French courts (in principle, the courts of Marseille for the Seller's domicile).

In accordance with Article L612-1 of the Consumer Code, in case of dispute that cannot be resolved amicably, the Customer may resort to the Consumer Mediator at: economie.gouv.fr/mediation-conso.
