1Purpose
These Terms of Use (hereafter "ToU") set out the rules for accessing and using the AperoRoom service (aperoroom.com), published by Benoit Guionie (ECAB13). They govern the use of the service, as distinct from the Terms of Sale, which govern the purchase of credit packs.
AperoRoom is an online get-together service: you create or join a live "Room", you propose YouTube videos, and a random draw picks the next video shown on the shared screen.
By creating an account and using the service, you acknowledge that you have read and accepted these ToU without reservation. If you do not agree with these terms, please do not use the service.
2Access to the service & account
Access to the core of the service requires creating an account. When you sign up, you agree to provide accurate information and to keep it up to date.
- An account is personal: one person per account, and one account per person.
- You are responsible for keeping your credentials confidential and for any activity carried out from your account. Notify us without delay in case of unauthorized use.
- The service is intended for people aged at least 15. Below that age, the consent and presence of a parent or legal guardian are required.
You can access the service from any modern browser. Some features may be reserved for accounts that have reached a certain tier (see the Terms of Sale).
3Acceptable use
AperoRoom is a place for good times. So that everyone can enjoy themselves, you agree to use the service fairly and respectfully. The following are notably prohibited:
- Any illegal, hateful, violent, pornographic, discriminatory content, or content contrary to public order.
- Harassment, insults, threats, or any degrading behavior towards other participants, in Rooms as well as in chat.
- Spam, unsolicited advertising, fraudulent links, or any phishing attempt.
- Identity theft, infringement of others' rights, or sharing private information without consent.
- Any attempt to circumvent, hack, or overload the service.
Respecting others is the basic rule: we're here to have fun, not to spoil someone else's.
4YouTube content & third parties
Videos are proposed and played through the YouTube API. AperoRoom hosts no video: we simply display content already publicly available on YouTube.
By proposing or watching videos, you agree to comply with YouTube's Terms of Service as well as Google's.
AperoRoom is not responsible for the content of third-party videos, their availability, their removal by YouTube, or geographic or age restrictions decided by rights holders. Responsibility for proposed content lies with the user who shares it.
5Credits & ice cubes
The service runs on a virtual currency, credits ("ice cubes"). They are used in particular to create Rooms and propose videos.
Purchase terms, pack prices, the right of withdrawal, and the refund policy are described in the Terms of Sale, which prevail on this point.
Credits have no monetary value outside the service, are not transferable from one account to another, and cannot be converted into cash.
6Moderation & sanctions
To ensure a healthy environment, AperoRoom reserves the right, at any time and without notice, to:
- Remove or hide any content (video proposal, chat message, Room) that breaches these ToU.
- Issue a warning, temporarily suspend, or permanently delete an account in case of breach.
In case of serious or repeated violation of the rules, no compensation or refund of remaining credits may be claimed. You can report any abuse to us via the contact page.
7Account deletion
You may request the deletion of your account at any time, from your personal area or by writing to us via the contact page.
Deletion results in the loss of remaining credits and access to associated Rooms. Details on how your personal data is handled after deletion are set out in the Legal Notice and our privacy policy (GDPR).
8Liability
The service is provided "as is", on a best-effort basis. AperoRoom does everything possible to ensure continuous access but does not guarantee uninterrupted availability: maintenance, updates, technical incidents, or external dependencies (YouTube API, host, payment partner) may temporarily disrupt the service.
AperoRoom cannot be held responsible for temporary interruptions, for data loss beyond its control, or for third-party content displayed through the service. The site is hosted by LWS.
9Intellectual property
The AperoRoom brand, its logo, the site's design, its texts, its code, and its graphic elements are the property of the publisher, Benoit Guionie (ECAB13), and are protected by intellectual property law. Any unauthorized reproduction is prohibited.
The content you post (messages, video choices, Room name) remains yours. By sharing it on the service, you simply grant AperoRoom the right to display it to participants as part of operating the service.
10Changes to the ToU & applicable law
These ToU may change to keep up with the evolution of the service or of regulations. The applicable version is the one published on the site at the time of your use. In case of significant changes, we will inform you by an appropriate means.
These ToU are governed by French law. Any dispute relating to their interpretation or execution that cannot be resolved amicably falls under the jurisdiction of the French courts (in principle those of Marseille, the publisher's place of residence).
